I. Inquiry into migrant worker identity 1. Ministry of Interior National Immigration Agency provides websites to deliver information of “Electronic Alien Resident”, where the employer can check if a migrant worker has legal work status before employed. (1)If the inquiry result shows that he or she holds a legal ARC card, it appears a photo which is line with that on the ARC as follows: (2)If the inquiry result shows that he or she does not hold a legal ARC, it illustrates “The data is inconsistent” as follows: 2.In accordance with the Employment Service Act, an employer can only hire an expat to do the work within the industrial classification stipulated by the Ministry of Labor (MOL). For example, they can work as a manufacturing technician, In-home caregiver, chef and artist, etc. Before applying for and getting the work permit with the MOL, a company, restaurant and people can’t employ an expat. 3.When urgently needing a caregiver at home or hospital, you can inquire into the websites of the legal employment services agencies. Someone handing out a business card or directly giving an introduction that they have legal migrant caregiver available, but actually they don’t have legal documents for work. Not every legally registered company is the Private Employment Service Agency who has been granted the permit by the MOL, to deal with the business of introducing the migrant worker. The exceptional circumstance where the employer does not need to apply for the work permit with the MOL is when the expat has the following identity: (1) Foreign spouse: someone who has legal purpose of stay and is married to a Taiwanese having household registration in Taiwan (2) International student: the current student who has legal purpose of stay and has applied for and obtained a work permit III. Steps to verify an ID 1. Steps to verify the ID of an expat who is going to be employed: (1) Three important steps, asking the purpose for coming Taiwan, looking into the documents and taking a picture of documents, (2) The expat can be employed by a restaurant, a snack bar or an individual is a foreign spouse with whom the employer has to check his or her identification card or ARC and Household Registration Transcript. An international student can also be hired, with whom the employer has to check his or her ARC, Student identity card and Letter of work permit.
